Terms of Service

1. Acceptance & Binding Effect

These Terms of Service (the “Terms”) form a binding legal agreement between you and HERE FOR HELLO LLC, an Oregon limited liability company (“Here for Hello,” “we,” “us,” or “our”), for use of the Here for Hello service (the “Service”). You accept these Terms by tapping the separately presented “Agree and continue” button. Google or Apple sign-in and location sharing are separate later actions and do not replace that assent. If you do not agree, do not continue into the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract under the laws of the jurisdiction where you reside. You must not be barred from using the Service under any applicable law. By tapping the button you represent and warrant that each of these requirements is true and will remain true for the duration of your use of the Service.

3. The Service: What It Is — and What It Isn't

Here for Hello is a casual social-discovery platform that displays approximate presence for users who have affirmatively opted in to be visible and lets each user send one other user a single, fixed-content greeting (“hello”). Verified users may also publish a time-bounded “Plan” with an activity, public meeting point, and start and end time. Other signed-in adults nearby may indicate that they are in. A Plan is an invitation, not a promise that the host or any attendee will appear or behave safely.

The Service is not an emergency service, background-check service, guarantee of identity, or guarantee of another person's conduct. Anything that happens after the fixed greeting — including any conversation, meeting, transaction, or relationship — is a voluntary interaction between adults outside the Service. We remain responsible for operating the product, handling data, responding to reports and known risks, and performing duties the law places on us.

4. Anonymous Accounts & Profile Content

Accounts on the Service are anonymous by design. You may add a display name, a short biography, and one profile photograph. You must not impersonate any other person, upload content depicting another individual without that person's explicit consent, or include in your profile any content that is sexually explicit, violent, depicts minors in any way, contains contact information for the purpose of solicitation, includes commercial advertising, or is otherwise prohibited under Section 7.

5. Verification and Personal Safety

An “ID checked” mark means only that Stripe matched a government identity document to a selfie during an optional check. It is not a criminal background check, age guarantee, or promise of character, intentions, photographs, statements, conduct, or current location. The Service makes no representation or warranty about any user, and no display name, biography, photograph, or location displayed through the Service should be relied upon as accurate. Any user may be lying about any or all of the foregoing. Treat every interaction with the same caution you would apply to a stranger on the street.

You are solely responsible for evaluating every other user you encounter and for every decision you make in connection with the Service, including but not limited to whether to send a greeting, whether to respond to a greeting, whether to communicate with another user off-platform, whether to meet another user in person, where to meet, when to meet, what to disclose, and how to protect yourself before, during, and after any such meeting.

The identity check is an optional, one-time purchase and not a subscription. Stripe Checkout shows the exact price before you pay. Purchasing a check does not guarantee that Stripe will verify an identity, does not purchase preferential treatment, and does not exempt an account from moderation.

You may request a full refund within 30 calendar days after the charge through the Contact page by choosing “Payment or refund.” Include the email used for the account or Checkout and the approximate charge date, but do not send an identity document, selfie, card number, or bank information. We also refund duplicate or unauthorized charges and provide any additional remedy required by law. Stripe or your financial institution may need additional time to post an approved refund.

A refund, charge reversal, or payment dispute revokes the “ID checked” mark and any ability that depends on an active checked status, including hosting a Plan. A refund does not remove an account from the Service or prevent you from using free features. We do not charge a cancellation fee because there is no subscription to cancel.

Hosting a Plan requires an active ID-checked status. Hosts must choose a lawful public place, intend to be present, provide accurate timing, and cancel a Plan they no longer intend to host. Joining a Plan creates no contract with the host or other attendees and does not transfer any responsibility for your personal safety to the Service.

6. Meeting Risks & Safety

You expressly acknowledge that meeting strangers in person carries inherent and unavoidable risks — including physical harm, sexual assault, robbery, kidnapping, harassment, fraud, identity theft, financial loss, emotional distress, and exposure to communicable disease.

You decide whether, when, and where to meet another user. Use public, populated places, tell a trusted person your plans, arrange your own transportation, and leave or contact emergency services if you feel unsafe. These precautions reduce some risks but cannot eliminate them. Nothing in these Terms releases Here for Hello from liability for its own negligence, willful misconduct, violation of statutory rights, or failure to perform a duty that applicable law does not allow us to waive.

Report concerning behavior through the in-app reporting tool. Call 911 or the appropriate local emergency service when someone may be in immediate danger; Here for Hello is not an emergency-response service.

7. Prohibited Conduct

You agree that you will not, and will not attempt to:

  • harass, threaten, stalk, defame, intimidate, or discriminate against any other user;
  • upload, post, or transmit content that is unlawful, sexually explicit, depicts minors in any context, depicts or promotes violence, infringes any intellectual-property right, or violates the privacy or publicity rights of any person;
  • use the Service to facilitate prostitution, commercial sexual activity, human trafficking, or any conduct prohibited under 18 U.S.C. § 1591;
  • use a profile, greeting, Plan, or any other Service surface to seek, offer, arrange, or promote sexual contact or sexual services, whether commercial or not;
  • traffic people, harass others, or advertise unlawful goods or services;
  • create more than one account, falsify or spoof your location, impersonate any person, or use any automated means (including bots, scrapers, crawlers, or harvesters) to access, scrape, interact with, or replicate the Service;
  • interfere with the operation of the Service, attempt to gain unauthorized access to any system or account, circumvent any security measure, or reverse-engineer the Service;
  • encourage or assist any third party to do any of the above.

These Terms do not limit rights granted under the third-party licenses identified in our map-data notices. Those licenses apply to the covered public map data and software, not to member content, personal information, accounts, or other protected parts of the Service.

8. Content You Provide; License to Us

You retain ownership of the content you upload. You grant Here for Hello a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, transmit, process, and create derivative works of that content solely for the purpose of operating, securing, and improving the Service. You represent and warrant that you own or have the rights necessary to grant this license and that the content does not infringe any third-party right.

9. Child Sexual Abuse Material — Zero Tolerance

We prohibit child sexual abuse material (“CSAM”) and sexual exploitation of minors. When we obtain actual knowledge of facts that trigger a reporting duty, we will report to the National Center for Missing & Exploited Children as required by 18 U.S.C. § 2258A, preserve required information, and take appropriate account and content action. This statement does not promise universal monitoring or perfect detection.

10. Block, Report, and Termination

We may suspend or terminate your account, with or without notice and in our sole discretion, for any reason, including any conduct we determine in good faith is harmful, abusive, fraudulent, or in breach of these Terms. You may report another user's conduct through the in-app reporting tool. We triage reports under our safety process and may preserve information, restrict visibility, suspend an account, remove an ID checked mark, or refer a matter when appropriate. Payment for an identity check does not buy immunity from these rules. We cannot promise a particular result or response time for every report. Termination of your account does not relieve you of obligations that survive these Terms.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranty of any kind, express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, security, availability, or that the Service will be uninterrupted or error-free. We do not warrant the identity, age, character, conduct, or trustworthiness of any user.

12. Limitation of Liability

To the fullest extent permitted by law, in no event will the Here for Hello be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity, or substitute service, arising out of or related to your use of the Service, even if advised of the possibility of such damages. The total cumulative liability of Here for Hello to you for any and all claims shall not exceed one hundred united states dollars ($100.00) or the amount you have paid us in the twelve months preceding the claim, whichever is greater. The Service includes free features and may offer optional paid features, including the one-time identity check described above. Applicable law may not permit some limitations, in which case those limitations apply only to the extent permitted.

13. Indemnification

To the extent permitted by law, you agree to indemnify Here for Hello against third-party claims caused by your unlawful conduct, your material breach of these Terms, content you submit, or your violation of another person's intellectual-property, privacy, or publicity rights. This obligation does not apply to a claim caused by Here for Hello's own negligence, willful misconduct, or violation of law.

14. Disputes and Applicable Law

Please use the Contact page to give us a reasonable opportunity to understand and resolve a dispute informally. These Terms are governed by the laws that apply to you and the operator; nothing in these Terms removes a consumer right, forum, or remedy that cannot lawfully be waived. Any arbitration, class-action waiver, choice-of-law clause, or forum-selection clause must be added through a future conspicuous agreement reviewed for the jurisdictions where the Service operates.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date and presented through a renewed “Agree and continue” action before you can enter the Service. Continued use alone does not record acceptance of a material revision.

16. Severability & Entire Agreement

If any provision of these Terms is held to be unenforceable, the provision shall be construed to give it the maximum effect permitted by law, and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Here for Hello regarding the Service and supersede any prior or contemporaneous understanding on the same subject.
